Council Meeting Minutes 7-17-2023

REGULAR COUNCIL MEETING

July 17, 2023

     The City Council of the City of Fayette, Iowa, met Monday, July 17, 2023, at 6:00 pm in the Community Room at the Fayette Community Library pursuant to law and rules of said council, Mayor Wood presiding. The meeting began with the Pledge of Allegiance.

     Roll call: Present - Council members Lowery, Post, Potratz, Scott and Tucker.

     Moved Tucker, seconded Potratz, to approve the consent agenda items consisting of the regular meeting minutes of 7/3/23 and the claims list of 7/1/23-7/14/23. Roll call, all ayes, motion carried.

     Citizen Comments: Glen Smith of Fayette addressed the council with question on his property at 309 E. Water Street. Smith said he checked with the court and learned that all charges had been dropped. He is concerned that council had taken final action to have property demolished and accepted a bid from Granger Construction. Mayor Wood responded to Mr. Smith that the city attorney would be contacting him regarding this situation.

     Scott Bowen from Fayette expressed concern over the lawn care ordinance. Several lawns in the community have not been mowed all year. Mayor responded that Fayette Police Chief Davis had delivered a citation and that the council wants to make sure all due diligence is in order before the city mowed the property and assess their taxes.

     Moved Tucker, seconded Lowery, to approve the agenda as presented. All ayes, motion carried.

     Upon recommendation from the Mayor and the Fayette Community Library Board of Trustees, moved Tucker, seconded Potratz, to appoint Louisa Tindall to the Fayette Community Library Board of Trustees. Four ayes, one abstention, motion carried.

     Mayor Wood reported that the city had received 15 applicants for the city administrator/clerk position. The selection committee chose three to interview with one withdrawing their resume. Also, the fire department had withdrawn James Hanson's application to join the fire department.

Councilmember Scott questioned information received on the Fayette Ambulance Corporation by-laws. Mayor Wood responded that the city attorney is working with Rick Hofmeyer, president of the Fayette Ambulance Corporation to work on a 28E Agreement.

          Moved Post, seconded Lowery, to accept written reports from special committees; the Fayette Community Library Board of Trustees meeting minutes from 3/8/23, 4/12/23 and 5/10/23 the Fayette County Economic Development and Tourism Quarterly Report from April-June 2023. All ayes, motion carried.

     After review of Resolution 2023-42 the council chose to table the Transfers for fiscal year 2023 until August 7, 2023, meeting.

     Moved Potratz, seconded Scott, to go into closed session per Iowa Code 21.5(1)(j) to discuss the purchase or sale of particular real estate only where premature disclosure could be reasonably expected to increase the price the City would have to pay for that property or reduce the price the City would receive that property. Roll call, all ayes, motion carried.

     Moved Lowery, seconded Potratz, to open regular session. Roll call, all ayes, motion carried.

     Moved Scott, seconded Lowery, to approve Resolution 2023-43, awarding of contract for a Phase I Environmental Site Assessment at 200 Volga Street. Roll call, all ayes, motion carried.

     There being no further business, Mayor Wood declared the meeting adjourned at 7:30 pm.
