June 5, 2023

     The City Council of the City of Fayette, Iowa, met Monday, June 5, 2023, at 6:00 pm in the Community Room at the Fayette Community Library pursuant to law and rules of said council, Mayor Wood presiding. The meeting began with the Pledge of Allegiance.

     Roll call: Present - Council members Post, Potratz, Scott and Tucker. Later, James Lowery was sworn in.

     Citizen Comments: Stacey Meyer (Fayette Fire Department Volunteer) from just outside the city of Fayette questioned the council as why they did not follow the new ordinance they recently passed which provides the volunteer fire department two chances to recommend a fire chief to the city council. Council member Scott later commented that the fire department was asked to provide a recommendation at the 5/1/23 and 5/15/23 council meetings and failed to make any recommendations.

     Scott Bowen from Fayette advised he feels the city council pushed the new ordinance on appointing a fire chief through and then the council ignored it. Bowen questioned on where a $500 donation from RAGBRAI to the fire department went. He also wanted to know where other checks to the fire department went. Bowen advised the city administrator is requesting a large pay increase and is far behind on his reports. Bowen feels the city council and the city administrator are not doing their jobs and the citizens are upset. Bowen stated Mayor Wood informed him that he had reviewed camera footage of council member Tucker interfering with police acts and Bowen questioned why charges have not been filed. Bowen feels Tucker should resign. Council member Tucker stated she has not been made aware of any conversations with the police department or Mayor Wood, nor has she been informed of the accusations.

     Moved Potratz, seconded Post, to approve the agenda as presented. All ayes, motion carried.

     Upon recommendation from the Mayor to appoint Randall Streeter as the Fayette Fire Chief for 2023, moved Scott, seconded Potratz, to appoint Randall Streeter as the Fayette Fire Chief for 2023. All ayes, motion carried.

     Mayor Wood informed the council that the WMT Tractorcade will be passing through the city of Fayette on Tuesday, 6/13, which is the 2^nd day of the Tractorcade. Wood also advised the city will be holding a public forum on Wednesday, 6/14, at 6PM to get citizens feedback on the city possibly accepting the Fayette Elementary School.

     City Administrator/Clerk McGrane updated the council that the city's current insurance provider will no longer be servicing city's and McGrane has been working with Lisa Kelly on getting quotes to present to the council. The water tower was drained, painted, and refilled. The city will be accepting bids starting this week for the demolition of 507 W. Clark St. McGrane is still working on the cell tower agreement negotiations. McGrane completed the annual renewal for the city's SAMS/DUNS/Unique ID number that is needed to apply for grants and receive federal funds. McGrane has been working with the North Fayette Valley Superintendent gathering information about the Fayette Elementary School for the council and the public forum. McGrane attended the safety meeting on 5/17 and the bi-annual full board Fayette County Economic Development & Tourism meeting on 6/1. McGrane provided an updated on the Homes for Iowa home, solar panels, KGAN TV filmed a short video at Klock's Island to air this summer and West Union Parks & Recreation will host some youth baseball/softball games at Cardinal Park this month.

     Fayette Police Chief provided an update on the new body camera system. The Fayette County Attorney is looking at the software and may assist with costs with the system because it is user friendly for his office. McGrane and Wood informed the council that the city of Oelwein has announced they will be reopening their dispatch center because it will be more cost-effective than signing a new 911 Dispatch Contract with the Fayette County Supervisors (FCS) and the Fayette County Sheriff's Office. The council was reminded that the cities of Oelwein, West Union and Fayette have been negotiating a new 911 Dispatch Contract with the FCS for the past year and half because the FCS are requesting to drastically increase the cost of the contracts.

     The city council was impressed with five citizens interested in filling the vacant city council seat. Post felt it would be fair to appoint someone off the last city election. James Lowery ran and was one vote away from winning a city council seat at the last election. Potratz stated previous councils have appointed vacant seats like that in the past.

     Moved Post, seconded Potratz, to approve appointing James Lowery to the Fayette city council effective immediately and to serve until the end of the term. All ayes, motion carried.

     James Lowery was sworn in as a Fayette city council member at this time and voted throughout the rest of the meeting.

     McGrane provided updates to the previous UIU Law Enforcement Services agreement. Moved Potratz, seconded Scott, to approve Resolution 2023-34, approving the 2023-2024 Law Enforcement Services Agreement between the City of Fayette and Upper Iowa University revised. Roll call, all ayes, motion carried.

     Moved Post, seconded Potratz, to acknowledge receipt of the Fayette Parks and Recreation board meeting minutes from 4/10/23. All ayes, motion carried.

     Moved Tucker, seconded Potratz, to go into closed session per Iowa Code 21.5(1)(j) to discuss the purchase or sale of particular real estate only where premature disclosure could be reasonably expected to increase the price the City would have to pay for that property or reduce the price the City would receive that property. Roll call, all ayes, motion carried.

     Moved Lowery, seconded Scott, to open regular session. Roll call, all ayes, motion carried.

     Moved Potratz, seconded Post, to direct the City Administrator to move forward with the proposed action discussed in closed session. All ayes, motion carried.

REGULAR COUNCIL MEETING

May 15, 2023

     The City Council of the City of Fayette, Iowa, met Monday, May 15, 2023, at 6:00 pm in the Community Room at the Fayette Community Library pursuant to law and rules of said council, Mayor Wood presiding. The meeting began with the Pledge of Allegiance.

     Roll call: Present - Council members Post, Potratz and Scott; Absent - Tucker. One council vacancy.

     Moved Potratz, seconded Post, to approve the consent agenda items consisting of the regular meeting minutes of 5/1/23 and the claims list of 4/29/23-5/12/23. Roll call, all ayes, motion carried.

     Citizen Comments: Tim O'Brien, a Westfield Township Trustee and from Fayette County, asked where the city was at with appointing a Fire Chief. O'Brien advised he is aware the North Fayette Valley school board has offered the Fayette Elementary school to the city of Fayette. He recommended having the school board tear down the gym before the city accepts the donation. O'Brien was advised the appointment of the Fire Chief was on the current agenda and the Fayette city council will be having a public forum for people to voice their opinions about the Fayette Elementary school in the near future.

     Scott Bowen from Fayette advised at the last council meeting several concerns were brought up and need to be addressed immediately. Bowen advised city council members are interfering with police business and that is against the law. He recommended an investigation be conducted and the Mayor needs to back the police department. Any council members interfering should resign immediately.

     Joseph Horstman from Fayette voiced his concerns on the growing problem of college students causing issues in Fayette. Susan and him have filed several complaints with the police. They had windows shot out by BB guns at two of their homes and nothing was done. Horstman feels like there is some influence from the city council on the police department. Horstman filed other complaints with the Fayette police department and the Fayette County sheriff's office involving his prior employer, Big Rock Country Club, and nothing was done. Horstman concluded by stating he is not in support of the council appointing Nancy Wulfekuhle to the city council.

     Brenda Hildebrand from Fayette inquired why the council has not been more progressive with getting more businesses, including a convenient store, to the city of Fayette. Hildebrand advised she has not seen any grants get awarded to Fayette recently. Hildebrand was advised that some council members have reached out to new businesses and it is a tough process. The city has applied for grants but have not been awarded any.

     Nancy Wulfekuhle from Fayette advised that maybe the city can focus more on some Main Street Iowa grants and hopefully the new Fayette Chamber can assist.

     Adrianna Ruroden of Fayette advised her and her husband were at the last council meeting explaining their problems with the college students including them running through their property and blasting music in their windows. Ruroden advised they have reported the issues multiple times to the police and inquired if the students received warnings, fines or how were the issues handled. Mayor Wood will follow up with her questions. The council members advised they do not interfere with any complaints made to the police and have not denied any training or equipment the police department has requested.

     Moved Post, seconded Potratz, to approve the agenda as presented. All ayes, motion carried.

     Mayor Wood advised those in attendance that their concerns raised at the meeting are acknowledged by the city administration. The Mayor, Fayette Police Chief and the City Administrator will work on better communication with the Upper Iowa University (UIU). Police Chief Davis will be speaking with UIU to set the stage for a successful 2023-2024 school year. The Mayor will have Chief Davis respond to the residents still having some concerns and issues. Wood spoke about National Police Week and his support of the Fayette Police Department.

     Moved Scott, seconded Potratz, to appoint Roger Post to the Fayette Ambulance Chief for 2023. All ayes, motion carried.

     The council advised the Fayette Fire Department had a few opportunities made available for them to recommend a Fire Chief to the council as they were advised and they have chosen not to. The council will move forward at the next council meeting by having the Mayor recommend a Fayette Fire Chief for 2023. Moved Potratz, seconded Scott, to have the Mayor move forward to appointing a Fayette Fire Chief at the next city council meeting. All ayes, motion carried.

     Moved Post, seconded Scott, to table the request until further information is obtained on appointing James Hanson to the Fayette Fire Department. All ayes, motion carried.

     City Administrator/Clerk McGrane advised the council the city does not have to sign any contracts for the new FirstNet cell phones for the police and public works departments. McGrane will have Chief Davis continue the process to switch over to FirstNet. McGrane is waiting for the Iowa Department of Natural Resources to return his messages on further confirmation on the removal of the two condemned homes. McGrane is still working on the cell tower agreement with American Tower and Tower Genius. He will hopefully have an update at the next council meeting. McGrane has also continued to work on the process of selling of the Homes for Iowa home, working on records requests for the public, working with a business on renting 9 S. Main Street, met with a garbage carrier on 5/11 with Mayor Wood and they will presenting that information at a future meeting, attended the bid opening on 5/11 for the Volga Trail project and continued to gather information for the council and advised the Fayette Ambulance Service will be celebrating their 50^th anniversary on Wednesday, 6/24 with an open house from 5:30-8PM at the ambulance garage.

     Fayette Police Chief Davis sent out a written email report to the council.

     Fayette Public Works Director Hildebrand informed the council he is waiting for parts to transfer the other water well over to the liquid chlorination system.

     This being the time and place posted for a public hearing on the proposed contract documents and estimated costs for improvements for the Fayette-Volga River Multi-Use Trail Surfacing, Mayor Wood opened the hearing and asked for comments. The city has not received any written comments. Brenda Hildebrand from Fayette inquired if the city will have funds to complete the trail and asked how it will benefit the city of Fayette. McGrane provided a few options on how the city could fund the project, including using Hotel-Motel tax funds and Local Option Sales Tax funds. Scott Bowen from Fayette advised the city has had to finish and pick-up the slack from Upper Iowa University multiple times and he does not feel the city should complete this project that was supposed to be completed by them. Jason Rohde from Fayette County inquired if the original agreement to complete the trail was reviewed and if it states that UIU is responsible for the trail. Rod Marlatt, Director of Fayette County Conservation (FCC), addressed the council and citizens by stating the trail was supposed to be completed a decade ago and it has not happened. The FCC has been taking care of the maintenance and upkeep of the trail, including mowing and trimming, since the trail was constructed. Marlatt advised if the trail is not going to be completed, the FCC will discontinue the maintenance and upkeep. There being no further comments, Wood closed the hearing.

     Jon Biederman with Fehr Graham Engineering advised that on 5/11/23, five (5) bids were opened and read and prices for both alternatives were excellent. The opinion of probable cost and bid totals were as follows (Base Bid and Alternate 1 is for PCC = Alt1; Base Bid and Alternate 2 is for Asphalt = Alt2): Engineer's Estimate $274,838 (Alt1), $234,743 (Alt2); Bacon Concrete LLC $246,381.70 (Alt1), $211,067.70 (Alt2); Wicks Construction, Inc. $248,366 (Alt1), No Bid for Alt2; Shift Companies $269,625 (Alt1), $260,013 (Alt2); Midwest Concrete, Inc. $228,211.71 (Alt1), $233,844.95 (Alt2); Rausch Construction, Inc. $267,494 (Alt1); $266,364 (Alt2). Fehr Graham recommended the city award the Base Bid and Alternate 1 (PCC) to the low bid, Midwest Concrete, Inc. of Peosta, Iowa, with a cost of $228,211.71. McGrane updated the council on the grants that were recommended he look into as well as other grants he researched for this project. McGrane could not find any that this project would qualify for because they have either already been awarded for the first part of the trail and we were unable to apply again, or the project did not meet the necessary requirements. Post recommended the city communicate with the Fayette County Department of Natural Resources to find out if we can work something out with them on taking over the trail as it is now. Post advised another option is to use crushed limestone to complete the trail as other communities have done to make the project less expensive. Potratz agreed with Post and feels this is quite a bit of money to finish the trail. Public Works Director Hildebrand recommended we repair what needs fixed on the trail and then maybe the county would be willing to accept the trail as it is. Hildebrand advised if the Fayette Public Works department had to maintain the existing trail, it would only take 15 minutes each time.

     Moved Post, seconded Potratz, to not approve completing the paving of the recreation trail to the Volga River Recreation Park. All ayes, motion carried.

     This being the time and place posted for a public hearing to sell 207 Alexander Street, Fayette, Iowa (the Homes for Iowa Home), Mayor Wood opened the hearing and asked for comments. Rick Hofmeyer from Fayette asked how much the city would be selling the home and property for and was advised the asking price of $130,000. Nancy Wulfekuhle from Fayette inquired if the buyers met the low-income requirements and was advised the buyers do. Wood closed the hearing.

     Moved Potratz, seconded Post, to approve Resolution 2023-32, directing the sale of the city's interest in 207 Alexander Street, Fayette, Fayette County, Iowa (the Homes for Iowa home). Roll call, all ayes, motion carried.

     The council advised they are not interested in reconsidering the options of painting the water tower that Mayor Wood has recommended.

     Moved Post, seconded Potratz, to accept and acknowledge receiving the Fayette Ambulance Service meeting minutes from 4/5/23, the Fayette Fire Department meeting minutes from 5/2/23, and to table the Fayette Safety meeting minutes. All ayes, motion carried.

     Rick Hofmeyer and other representatives with the Fayette Ambulance Service Incorporation (FASI) addressed the council and requested the Miller Trust money that was donated be turned over to the FASI. They advised the Miller Trust trustees donated the money to the Fayette Ambulance Service and not to the city of Fayette. The recent Resolution passed by the council has earmarked the funds for the Fayette Ambulance Service and at any time the city council can vote to change the use of the funds. By the city turning the funds over to the FASI, it would ensure the funds are spent properly. Hofmeyer read some of the by-laws of the FASI. The service is concerned that the city could change how the interest earned from the funds could be used in the future. The members of the FASI advised they received around $3,500 at their last fundraising event. McGrane explained the city's auditor and attorney advised the funds were to be deposited into the city's account and not in the FASI account because of the wording on the court documents. McGrane briefly explained how the city funds work for the ambulance service and that any extra funds the ambulance receives are transferred into the city ambulances savings account for future purchases. McGrane advised he has communicated with the Iowa League of Cities and attended a Fayette Ambulance Service meeting to explain what steps could be taken for the city to possibly turn the donated money over to the FASI. The FASI provided McGrane with an updated copy of their by-laws and McGrane will communicate with the city attorney. No formal action was taken.

     Moved Potratz, seconded Scott, to extend the regular council meeting beyond the 2-hour time limit until all agenda items are completed. All ayes, motion carried.

     Moved Potratz, seconded Scott, to approve Resolution 2023-33, adopting the job description for the part-time Public Works Technician. Roll call, all ayes, motion carried.

     Citizen Comments: Stacey Staab from Fayette expressed his concerns that he has filed multiple complaints with the Fayette Police Department on college students causing issues at his house over this last school year. Staab, his wife and one year old child have been woken up multiple times from extremely loud noises at 3am or 4am. Staab and his family feel they have been harassed by the students because they were purposely blaring loud music in Staabs' window. Staab explained there are about 3 homes around his that house college students and he has called the police numerous times of noise complaints and they talk to the students. Staab inquired if there were any repercussions for multiple incidents for noise complaints.

     Nicole Bregitsprecher from Fayette expressed her concerns that college students have tried to break into her property, have vandalized her child's property and have been extremely loud waking up her children over the last few years including this past weekend. Bregitsprecher advised there are multiple students that walk around the area, most likely walking from college house to house, that are causing the issues. She has called the police and they respond but she feels nothing is being done. At times they have seen the police break-up the students at one house and all the students go to another house and continue to be loud and disruptive.

     Fayette Police Chief Davis advised that his officers are responding to quite a few of these calls and the officers feel they do not have all of the city councils support in the department. They are handling the calls the best they can but until the officers feel support from the city council, their resolutions to the issues are limited.  

     Moved Post, seconded Tucker, to approve the agenda as presented. All ayes, motion carried.

     Mayor Wood advised the city did not receive meeting minutes from the fire department and did not receive the meeting minutes in adequate time from the ambulance to place on the agenda to appoint chiefs. We will plan on appointing the chiefs at the next council meeting. Wood informed the council that five Fayette residents are interested in filling the vacant city council position, Darwin Dean, Mike Jager, Janice Larson, James Lowery, and Nancy Wulfekuhle. Wood is still working on getting a dentist back to Fayette and would now like to hand the information he has over to the Economic Development Committee to further work on an incentive.

     City Administrator/Clerk McGrane updated the council on a few things including: most of the CD's have been transferred; city bond paperwork was completed and money transferred to city's account; McGrane attended training/conference in Des Moines 4/19-4/21; Shelby Sebring/The Beauty Room paid off the balance on the Revolving Loan Fund; completed required water, American Rescue Plan and quarterly reports; and the FY24 budget was completed and submitted. Upper Iowa University's Fayette Appreciation Day went well with an approximately 350 people completing around 17 projects around the community including the cemetery, Rainbowland, and the Rec trails.

     Fayette Public Works Director Hildebrand advised the council the new chlorination system (switching from gas to liquid) was installed at one well today and hopefully next week the other well will be switched over.

     Moved Potratz, seconded Post, to approve publishing the notice to the public that the council will be appointing someone to the vacant city council position at the June 5 city council meeting. All ayes, motion carried.

     Mayor Wood and McGrane met with an asbestos inspector on 4/27 and was informed the city may demolish one residence per calendar year without testing for asbestos. McGrane has reached out to the Iowa Department of Natural Resources and will get more information. Moved Tucker, seconded Potratz, to move to approve moving forward with advertising that we are accepting bids for demolition of the buildings located at 507 West Clark Street. All ayes, motion carried.

     Moved Post, seconded Potratz, to approve Resolution 2023-14 approving the Third Amendment to Real Estate Lease Agreement with Verizon Communications Inc. for the Cell Tower Real Estate. Roll call, all ayes, motion carried.

     Moved Tucker, seconded Potratz, to approve moving forward with switching city cell phones and hot spots to FirstNet Solutions. All ayes, motion carried.

     Moved Potratz, seconded Scott, to approve Resolution 2023-30 approving the 2023-2024 Law Enforcement Services Agreement between the City of Fayette and Upper Iowa University. Roll call, all ayes, motion carried.

     Moved Tucker, seconded Potratz, to approve the agenda, removing agenda item 11D, discussion and consideration in spending the library savings funds on a copy machine. All ayes, motion carried.

     Mayor Wood advised the council that he has been working with Delta Dental and the Iowa Economic Development on programs to try and bring a dentist to Fayette. There is a program, FIND - Fulfilling Iowa's Need for Dentists, Fayette is eligible for and Wood will provide more information as he continues to research. Mayor Wood also mentioned that he appreciated the work that Linda Tenney has done on the city council and wishes her and her family the best in the future.

     City Administrator/Clerk McGrane updated the council on the budget process and the N. Main Street project. McGrane also reminded everyone of Upper Iowa University's (UIU) Fayette appreciation day occurring this Wednesday, 4/19/23, and they will be working on projects throughout the community.

     Fayette Police Chief Davis informed the council he has been continuing to work on some recent police cases.      

     Fayette Public Works Director Hildebrand advised he has received the Iowa DNR permits for the water project and is waiting for a few parts.

     This being the time and place posted for a public hearing on the proposed fiscal year 2024 estimated budget, Mayor Wood opened the hearing and asked for comments. There being no comments, Wood closed the hearing.

     Moved Tucker, seconded Scott, to approve Resolution 2023-27 approving the fiscal year 2024 budget and certification of taxes. Roll call, all ayes, motion carried.

     This being the time and place posted for a public hearing on the authorization of a loan and disbursement agreement and the issuance of not to exceed $55,000 for police equipment (body cameras and tasers), Mayor Wood opened the hearing and asked for comments. There being no comments, Wood closed the hearing.

     Moved Potratz, seconded Scott, to approve Resolution 2023-28 instituting proceedings to take additional action for the issuance of not to exceed $55,000 for police equipment (body cameras and Tasers) general obligation loan and disbursement agreement and contract agreement.      Moved Potratz, seconded Tucker, to acknowledge receipt of the Fayette County Economic Development and Tourism quarterly report from January through March 2023 and the Fayette Community Library Board of Trustees meeting minutes from 2/8/2023. All ayes, motion carried.

     Moved Potratz, seconded Scott, to approve closing down the 200 block of South Main Street for the All Cardinal Reunion on July 15, 2023, from 11AM until midnight and allowing music to be played outdoors until midnight. All ayes, motion carried.

     Moved Tucker, seconded Potratz, to approve closing the 100 block of S. Main Street from 5:30PM to 9PM on the 3rd Thursday of the month starting in May until September 2023 for the Music, Motors and Market on Main. All ayes, motion carried.

     K&W Coatings, LLC, quote was presented and Mayor Wood spoke with the company and asked about not repainting Upper Iowa University on the water tower and possible replacing it with our new motto - Connecting Learning, Leisure and Life and they are estimating an additional $2,000-$3,000 to the cost in the estimate of $39,420.00. Moved Potratz, seconded Tucker, to approve moving forward with the K&W Coatings LLC quote for painting the water tower at $39,420 and to paint the tower the same as it is now including Upper Iowa University. All ayes, motion carried.

     Moved Tucker, seconded Scott, to approve setting a public hearing for Monday, May 15, 2023, at 6PM on the proposed contract documents and estimated costs for completing the recreation trail from Fayette to Volga State Park. All ayes, motion carried.

     Citizen Comments: Tim O'Brien, a Westfield Township Trustee and from Fayette County, advised he is present along with other township trustees to express their concerns regarding adequate fire coverage within their jurisdictions and to receive an update on the Fayette Fire Department.

     City Administrator/Clerk McGrane updated the council on the budget process, N. Main Street project, and a few Legislative bills to be aware of. McGrane advised we should soon be receiving information if we were selected for the BOOST program that we applied for recently. The council was reminded that Upper Iowa University (UIU) Appreciation Day is Wednesday, 4/19/23. UIU students, faculty and community members are encouraged to contact Amy Tucker to assist with projects around town. McGrane also provided information and options for the council to start considering in replacing council member Tenney when she resigns at the end of April.

     Police Chief Davis advised the council that Goodell was served a citation recently for abatement.

     Mayor Wood provided a written update on the Fayette Fire Department (FFD) that McGrane read to the council members and citizens. The written statement stated on 3/20/23 the city council approved the third and final reading of Ordinances 517 and 518. Both Ordinances have been published and are in effect. On 3/29/23, the mayor emailed the current Fayette Ambulance Service Chief, Roger Post, and FFD Chief, Jason Rohde, informing them of the Ordinances and to submit the volunteers recommendation for 2023 Chiefs to city hall by noon on 4/27/23 to ensure inclusion on the 5/1/23 city council agenda. Three new volunteers have been approved by the city council for the FFD so far this year. After the mayor met with Chief Rohde last week, the mayor suggested a number of reasonable, attainable and measurable 2023 objectives for the FFD to focus on improving the fire protection for the citizens. These included a 2023-25 firefighter recruitment and retention plan; ensuring that all incident or call reports are submitted within required time frames; submitting to the council for approval updated FFD bylaws that comply with the amended city code; provide city hall with copies of keys for the FFD building; and to purchase what is understood to be needed firefighter personal protective equipment. The mayor plans to meet with Chief Rohde in mid-April to discuss the merit of the suggestions with the goal of developing a FFD action plan for the remainder of 2023.

     Jeremiah Owens is currently a Strawberry Point law enforcement officer and Chief Davis would like to hire Owens as a part-time reserve Fayette officer. Owens was present to introduce himself to the council. Moved Potratz, seconded Scott, to approve hiring Jeremiah Owens as a part-time reserve Fayette police officer at the rate of $21.00 per hour.      Moved Tenney, seconded Potratz, to approve closing down the 100-block of S. Main St. for the UIU Spring Fling/Family Weekend from 4pm until midnight on 4/22/23, and allowing music outdoors until midnight. All ayes, motion carried.

     Citizen Comments: Scott Bowen from Fayette, advised he had been told the Fayette Ambulance Service only has about 8 volunteers that are active on the service. Bowen advised there are other distinct differences between the Fayette Fire Department and the Fayette Ambulance Service when comparing the two, including testing requirements. Bowen also expressed his concerns with the outdated equipment and gear at the fire department.

    Kevin Lehs from Fayette, expressed his concerns about the councils actions in regards to the fire department. Lehs advised the department not only responds to fire calls but also are dispatched to accidents, gas leaks, and active shooter calls. The fire department is supported by volunteers that feel strong about the organization and are a good team that is well trained and perform their duties safely. Lehs advised when there are distractions, teams are unable to stay 100% focused and safety can be compromised. Lehs is concerned the decisions the council are making are causing a liability to the city.

     Mayor Wood informed the council the North Fayette Valley Superintendent has provided some of the information the city has requested in regards to the Fayette Elementary school and he will review it.

     Upon recommendation from the City Administrator/Clerk to appoint Janell Scott as the Fayette City Treasurer for a 2-year term, expiring 12/31/2024, moved Potratz, seconded Tucker, to approve appointing Janell Scott as the Fayette City Treasurer for a 2-year term, expiring 12/31/2024.      Upon recommendation from the Fayette Fire Department to appoint Stacey Meyer and Scott Bowen to the Fayette Fire Department, moved Scott, seconded Post, to appoint Stacey Meyer and Scott Bowen to the Fayette Fire Department. All ayes, motion carried.

     Upon recommendation from the Fayette Fire Department to reappoint Jason Rohde as Fayette Fire Chief for 2023, moved Tucker, seconded Potratz, to approve reappointing Jason Rohde as Fayette Fire Chief for 2023. Ayes - Potratz and Tucker; Nays - Post, Scott and Tenney; motion failed.

     City Administrator/Clerk McGrane updated the council on the budget process and the N. Main Street project. McGrane explained we received all the new recreational trail signs that will be put up later this spring with the help of Upper Iowa University (UIU) staff and students. Public Works Director Hildebrand will check with UIU to see if they have any posts we can use. The city was not awarded the Fayette County Community Foundation grant to help fund the Fayette-Volga River recreation trail.

     Police Chief Davis updated the council on a recent police call. The police are working with the city attorney's office on issuing citations for nuisance abatement. The department also just completed a volunteer project last week.

     Public Works Director Hildebrand advised the council one of the water wells was repaired today.

     Moved Tenney, seconded Post, to approve the third and final reading of Ordinance 517. Roll call, all ayes, motion carried.

     Moved Tenney, seconded Post, to approve City Administrator McGrane to hire a company to perform asbestos testing for the two condemned homes without exceeding $4,000. All ayes, motion carried.

     McGrane provided updates to the current certificate of deposits (CD's) and interest rates. McGrane did reach out to the department supervisors and they recommended the council re-invest their CD's at the higher interest rates. Moved Tenney, seconded Scott, to approve the City Administrator to invest $250,000 of the RUT fund into a 9 month CD at Northeast Security Bank (NSB) at 4.6%, to re-invest Bolger CD#84 in the amount of $254,406.23 at Farmers Savings Bank in Arlington for 17 months at 4.8%, and to re-invest the following CD's at NSB at 4.6%: Flooding Sports Complex for 9 months, Bolger #81 for 9 months, Bolger #82 for 12 months, Bolger #83 for 12 months, Sewer for 12 months, Water for 9 months, Fire for 9 months, Ambulance #95 for 9 months, Ambulance #49 for 12 months and the Library for 12 months, and if any of the CD's from the departments were from donations, then the interest rate should roll back into the CD and accrue.      Moved Post, seconded Tenney, to acknowledge receipt of the Fayette Fire Department meeting minutes from 3/7/23 and Fayette Safety meeting minutes from 3/15/23. All ayes, motion carried.

     Maggie Burger with Speer Financial, Inc. spoke to the council via telephone in reference to the receipt of bids for the General Obligation Capital Loan Notes, Series 2023. Burger provided information and explained that three bids were received earlier in the day. The three bids included: Bankers' Bank, Madison, Wisconsin - 3.4883%; D.A. Davidson & Co., Denver, Colorado - 4.3883%; and Northland Securities, Inc., Minneapolis, Minnesota - 4.3994%. Burger advised in her opinion, the bid of Bankers' Bank, Madison, Wisconsin, is the best bid and is favorable to the city and should be accepted. Burger recommended the Notes be awarded to Bankers' Bank at a price of $398,900 at a true interest rate of 3.4883%.

     Moved Tenney, seconded Post, to approve Resolution 2023-18, directing the sale of $400,000 (or $398,900 per terms of offering) General Obligation Capital Loan Notes, Series 2023. Roll call, all ayes, motion carried.

     Moved Tenney, seconded Tucker, to approve Resolution 2023-19, approving the agreement between the city of Fayette, Iowa, and Fehr Graham Engineering to provide professional services for the Fayette Volga River multi-use trail surfacing. Roll call, Ayes - Scott, Tenney and Tucker; Nays - Post and Potratz; motion carried.

     McGrane and Hildebrand advised the council to defer the monthly reimbursement for cell phone charges Resolution. No formal action was taken.

     Moved Scott, seconded Tucker, to defer Resolution 2023-21, employee salaries, to the Personnel Committee for further review. All ayes, motion carried.

     Chief Davis advised the current tasers were purchased about 5 years ago and he is having concerns with the current body cameras. Davis provided a quote from Axon Enterprise, Inc. for approximately $10,234.17 per year for 5 years for new, updated tasers and body cameras for all the officers. The agreement includes online data storage for all the video, which would save the officers time and make it convenient to share the video with the city and county attorneys. If we went into an agreement, there would be a wait on the body cameras, but we would not be charged until we received them. Moved Tucker, seconded Tenney, to approve the purchase agreement with Axon Enterprise, Inc. for new police body cameras and tasers as presented. All ayes, motion carried.

     McGrane highlighted some of the items in the fiscal year 2024 (FY24) proposed budget estimate the Finance Committee is recommending. March 6, 2023

     The City Council of the City of Fayette, Iowa, met Monday, March 6, 2023, at 6:00 pm in the Community Room at the Fayette Community Library pursuant to law and rules of said council, Mayor Wood presiding. The meeting began with the Pledge of Allegiance.

     Roll call: Present - Council members Post, Potratz, Scott (joined at 6:09pm via telephone because out of town), Tenney and Tucker.

     Moved Tenney, seconded Potratz, to approve the consent agenda items consisting of the regular meeting minutes of 2/20/23 and the claims list of 2/18/23-3/3/23. Roll call, all ayes, motion carried.

     Citizen Comments: Elizabeth Meyer (Fayette fire volunteer) of Fayette, expressed her concerns that she felt the city council has not tried to work together with the Fire Department and get input. Meyer advised not one council member has taken initiative or stopped to talk to the fire volunteers to communicate or to show they care. Meyer advised that the mayor had drove by and it appeared he was taken notes as the volunteers were working on the fire trucks. She felt it was suspicious and the fire volunteers feel unsupported.

     Scott Bowen of Fayette advised his concerns with the new ordinance letting the mayor assign a new fire chief if the council doesn't agree with the fire department. Bowen feels the mayor or the council does not know the structure of the department or all the education required for a firefighter. Bowen believes the fire department only has one firefighter qualified to be chief and encouraged the council to vote no for the new ordinance.

     Bridget Fox (Fayette fire volunteer) of Randalia advised the mayor ignored the township trustees concerns and requests that were expressed at a recent budget meeting. Fox said she has heard that there were personnel issues with Fire Chief Jason Rohde. Fox advised if there is a personnel issue with Chief Jason Rohde, there has been no documentation of the issues provided to Rohde. Fox mentioned the council indicated they wanted a meeting with the fire department but not one member has reached out to set up a meeting.

     Moved Tenney, seconded Potratz, to approve the agenda as presented. All ayes, motion carried.

     Mayor Wood advised the 2023 WMT Tractorcade will be in Fayette County this summer and will be traveling through the city of Fayette on June 13. Wood, Davis, Tenney and McGrane met with Upper Iowa University (UIU) representatives to discuss a new law enforcement contract between the city of Fayette and UIU. Wood, Tucker and McGrane met with the North Fayette Valley Superintendent and School Board President to discuss the future of the Fayette Elementary school.

     Upon recommendation from the Fayette Fire Department to reappoint Jason Rohde as Fayette Fire Chief for 2023, moved Post, seconded Tucker, to suspend the Robert's Rules of Order rules and allow discussion prior to the vote. Roll call, all ayes, motion carried. Post asked the Fayette fire volunteers present if there were any new ways to recruit members that has been done. Bridget Fox advised they have 2 people ready to volunteer. Post asked if any more ideas for recruitment has been done. Fayette Fire Chief Jason Rohde advised he spoke to 5 people in the last year, 3 had conflicts and the other 2 are considering. Post researched recruitment ideas and shared a few, including placing yard signs throughout town, applying for a SAFER (Staffing for Adequate Fire and Emergency Response) grant, having an open house during Fire Prevention week, having a coffee with a firefighter event and utilizing social media. Fox advised they send out flyers for the annual Fire Dept. spaghetti supper fundraiser and include recruitment information. The department is also planning on having information and applications available at the supper this year. Rohde advised about 9 years ago he took a retention and recruiting class and feels recruiting college students does not help the department because they train them and then they leave for other departments. Fox advised the college students also frequently have school and sporting conflicts as well as curfews. Scott Bowen advised the current UIU student enrollment is mostly made up of student athletes that do not have the time to commit. Post advised the Fayette Ambulance Service currently has a UIU football player and UIU baseball player on the service. Post advised a public safety meeting was held about two or three years ago with this same recruitment conversation and quite a few ideas were presented but it doesn't appear that any suggestions were followed through. Tucker advised she is interested in leadership development and training and there has to be ways for someone to step up on the department if Rohde is not available. Tucker has been in a situation where she had to wait for a long time for the fire department to arrive. Susan Scott provided more suggestions including brochures to hand out at the supper fundraiser and talking to people waiting in line. There was no motion by the council to reappoint Rohde.

     City Administrator/Clerk McGrane updated the council on the N. Main Street/Old Hwy 150 project. McGrane advised grants and state/federal funding for projects like our N. Main Street project is difficult to receive. Fayette County received funding through the federal appropriation and a safety plan grant to assist them and surrounding counties with their large street project they will be completing over the next year. McGrane attended multiple meetings including the UIU law enforcement agreement meeting, Fayette Elementary school meeting, Fayette County Economic Development & Tourism Executive meeting, Tower Genius phone conference meeting, a Community Project Funding webinar, and an Infrastructure Investment and Jobs Act webinar. McGrane assisted Tucker with the BOOST program application and Tucker submitted it by the due date.

     Public Works Director Hildebrand advised the council the paperwork for the wells was submitted and we are waiting for the Iowa DNR to continue with the process.

     This being the time and place posted for a public hearing on the authorization of a Loan Agreement and the issuance of Notes to evidence the obligation of the City thereunder, not to exceed $500,000 General Obligation Capital Loan Notes, Mayor Wood opened the hearing and asked for comments. There being no comments, Wood closed the hearing.

     Moved Tenney, seconded Potratz, to approve Resolution 2023-15, instituting proceedings to take additional action for the issuance of not to exceed $500,000 General Obligation Capital Loan Notes. Roll call, all ayes, motion carried.

     Moved Potratz, seconded Tucker, to approve Resolution 2023-16, approving electronic bidding procedures and Distribution of Preliminary Official Statement for $400,000 General Obligation Capital Loan Notes, Series 2023, for ten years. Roll call, all ayes, motion carried.

     Moved Potratz, seconded Tenney, to approve the second reading of Ordinance 517, amending Chapter 35, Fire Department, Section 6.  Roll call, all ayes, motion carried.

     Moved Tenney, seconded Potratz, to approve the second reading of Ordinance 518, amending Chapter 36, Ambulance Service, Section 3. Roll call, all ayes, motion carried.

     Andrew Wenthe with UIU provided a letter to the city indicating the UIU Board of Trustees will need to deed over the property to the city, so the trail to Volga Recreation area can be completed. Fayette County Conservation Director Rod Marlatt provided a Resolution from the Fayette County Board of Supervisors dated 11-22-2010 supporting the recreational trail from Fayette to Volga River Recreation Area and meeting minutes from the Fayette County Conservation Board dated 12-1-2010 supporting the Resolution from the Fayette County Board of Supervisors. Moved Tenney, seconded Tucker, to approve getting bids for completing the trail with an 8 foot wide concrete or asphalt surfacing. Roll call, Ayes - Potratz, Scott, Tenney and Tucker, Nay - Post, motion carried.

     Moved Tenney, seconded Potratz, to approve Resolution 2023-17, accepting the agreement between the city of Fayette, Iowa, and Fehr Graham Engineering and Environmental to provide professional services for the Liquid Chlorination permit application for the Iowa Department of Natural Resources. Roll call, all ayes, motion carried.

     Moved Tucker, seconded Tenney, to approve endorsing the Turkey River Safari project by approving a site for the 2023 Safari scavenger hunt include the Fayette Trail located at the Open Air Market park. All ayes, motion carried.

     Moved Tenney, seconded Tucker, to approve removing Patricia Potratz and adding Nathan Post to all the city of Fayette bank accounts and safe deposit box. All ayes, motion carried.

     Moved Post, seconded Tenney, to approve requiring two city employees and/or city officials that are named on the city bank accounts be present and sign the withdrawal slip for all cash withdrawals from any of the city bank accounts. All ayes, motion carried.

     McGrane provided an updated list of all the city's certificate of deposits (CD's) as well as some area financial institutions CD interest rates. McGrane recommends the council review them and at the next council meeting decide if they would like to take out the CD's and reinvest in new CD's with higher interest rates. No formal action was taken.

REGULAR COUNCIL MEETING

February 20, 2023

     The City Council of the City of Fayette, Iowa, met Monday, February 20, 2023, at 6:00 pm in the Community Room at the Fayette Community Library pursuant to law and rules of said council, Mayor Wood presiding. The meeting began with the Pledge of Allegiance.

     Roll call: Present - Council members Post, Potratz, Scott, Tenney, and Tucker.

     Moved Tucker, seconded Potratz, approve the regular meeting minutes of 2/6/23 with the amendment of correcting the date in the first paragraph to Monday, February 6, 2023. All ayes, motion carried.

     Moved Potratz, seconded Tenney, to approve the claims list of 2/4/23-2/17/23. All ayes, motion carried.

     Citizen Comments: Jason Rohde (Fayette Fire Chief) of Randalia, inquired why the recommendation by the Fayette Fire Department for the appointment of the Fayette Fire Chief was not on the current city council agenda. McGrane advised the Fayette Fire Department meeting minutes with the recommendation were dropped off at city hall past the deadline for the city council agenda. McGrane explained sometimes he is able to get meeting minutes added to the council agendas if they come in late.

     Scott Bowen of Fayette advised the council the recommendation for the Fayette Fire Chief should be automatically placed under old business on the city council agenda.

     Moved Tenney, seconded Potratz, to approve the agenda as presented. All ayes, motion carried.

     Mayor Wood informed the council he spoke with Jeff Bradley about his vacant commercial building in downtown Fayette and the possibility of getting a dentist in there. Wood has researched some incentives for dentists and would like to work on getting a possible incentive drafted for Fayette.

     City Administrator/Clerk McGrane updated the council on the budget and that SF 181 passed the House and the Governor should be signing it soon. This legislation will alter the residential rollback for the budget we are working on, fiscal year 2024. This will also extend the city budget certification date to 4/30/23 because we will need to wait for updated property valuations from the county auditor. McGrane recommended postponing the Finance Committee meeting scheduled for 2/21/23 until a later date due to this delay. McGrane advised he has not had any recent interest in the new Homes for Iowa home and explained the process for awarding the sidewalk and marketing incentives.

     Public Works Director Hildebrand explained that one of the city wells has been down and he made repairs on the other well. Hildebrand advised he is moving forward with transitioning over to liquid chlorine versus gas sooner than planned because of the repairs that are needed.

     This being the time and place posted for a public hearing on the proposed contract documents and estimated costs for improvement of reconstruction of a portion of the North Main Street (Old Highway 150 North) and grading of shoulders, Mayor Wood opened the hearing and asked for comments. Jon Biederman, Senior Project Manager with Fehr Graham Engineering and Environmental, advised on February 16, 2023, five (5) bids were opened and read and prices for both alternatives were excellent. The opinion of probable cost and bid totals were as follows (Base Bid = BB; Alternate 1 is for PCC = Alt1; Alternate 2 is for Asphalt = Alt2): Engineer's Estimate $941,002 (BB+Alt1), $1,020,608 (BB+Alt2); Wicks Construction, Inc. $710,035.75 (BB+Alt1), no bid for BB+Alt2; Rock N Load/Upper Iowa Erosion Control $733,445.75 (BB+Alt1), $722,273.75 (BB+Alt2); Bacon Concrete LLC $767,655 (BB+Alt1), $835,021.75 (BB+Alt2); Skyline Construction, Inc. $909,075.81 (BB+Alt1), $855,329.26 (BB+Alt2); Tschiggfrie Exc. Co. $960,413.86 (BB+Alt1), $898,243.86 (BB+Alt2). Fehr Graham recommended the city award the Base Bid and Alternate 1 (PCC) to the low bid, Wick's Construction Inc. of Decorah, Iowa. There being no further comments, Wood closed the hearing.

     This being the time and place posted for a public hearing on the fiscal year 2024 proposed property tax levy, Mayor Wood opened the hearing and asked for comments. McGrane explained the purpose for the proposed tax levy. There being no further comments, Wood closed the hearing.

     Moved Scott, seconded Tenney, to approve Resolution 2023-11, adopting the proposed property tax levy for fiscal year 2024. Roll call, all ayes, motion carried.

     Moved Tucker, seconded Potratz, to approve the receipt of the Finance Committee meeting minutes from 2/7/23 and 2/13/23. All ayes, motion carried.

     Moved Tenney, seconded Post, to accept the receipt of the Fayette Community Library Board of Trustees meeting minutes from 12/14/22 and 1/11/23, the Fayette Fire Department meeting minutes from 2/14/23 and the Fayette Safety Committee meeting minutes from 2/15/23. All ayes, motion carried.

     Jon Biederman provided a spreadsheet with a list of signs needing replaced or added to the recreation trails throughout the city of Fayette and out to the Volga State Recreation park. Tucker advised she may have some Upper Iowa University (UIU) students interested in assisting with installing the signs in April. The council discussed if the city should move forward with completing the paved portion of the trail or not. McGrane provided a few financial options to fund the project using local option sales tax and hotel/motel tax revenue. The engineer's preliminary opinion of costs to complete the trail range between approximately $245,652.72 and $371,649.53, depending on the width of the trail and by using asphalt instead of concrete. Tucker also applied for a grant to help fund the project and we will find out in March if we are awarded funds. The council would like to wait until UIU confirms they are able to transfer the land over to the city before moving forward. Moved Tenney, seconded Tucker, to approve purchasing the suggested trail signs in the amount not to exceed $2500 plus shipping and handling. All ayes, motion carried.

     Moved Potratz, seconded Tenney, to approve the first reading of Ordinance 517, amending Chapter 35, Fire Department, Section 6. Roll call, all ayes, motion carried.

     Moved Tucker, seconded Scott, to approve the first reading of Ordinance 518, amending Chapter 36, Ambulance Service, Section 3. Roll call, all ayes, motion carried.

     McGrane advised even though the cost of the N. Main Street improvements project came in less than originally estimated, he left the not to exceed loan amount at $500,000. McGrane explained that means the council may borrow any amount up to $500,000. Hildebrand recommended the council only finance about half of the total project, as originally planned, to keep some funds available for future expenses and projects. Moved Tucker, seconded Post, to approve Resolution 2023-12, fixing date for a meeting on the proposition to authorize a Loan Agreement and the issuance of Notes to evidence the obligations of the City thereunder. Roll call, all ayes, motion carried.

     McGrane advised he was anticipating on presenting the third amendment to the real estate lease agreement to the council but the contract is still being reviewed. Moved Post, seconded Scott, to table Resolution 2023-14, accepting the third amendment to real estate lease agreement between the city of Fayette, Iowa, and Alltel Corporation D/B/A Verizon Wireless, until the contract is completely reviewed. Roll call, all ayes, motion carried.
